1. Acceptance of Terms

By creating an account or using Sweetlytics ("the Service," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

Sweetlytics is a pricing calculator designed to help home bakers estimate ingredient costs, labor costs, and suggested retail prices for their baked goods. The Service uses automated models, a curated ingredient price database, and publicly available market data to generate estimates.

Sweetlytics is a tool for educational and informational purposes only. It is not a licensed financial advisor, business consultant, or accounting service.

3. No Guarantee of Accuracy — Educational Use Only

• Ingredient prices are based on national average estimates and may not reflect your local grocery store prices, wholesale costs, or seasonal price fluctuations.
• Market pricing data is generated using general geographic information and may not accurately reflect current demand, competition, or pricing in your specific area.
• Labor cost estimates are calculated using regional minimum wage data as a baseline and may not reflect your actual skill level, market rate, or applicable labor laws.
• Profit projections (including monthly earnings estimates and what-if scenarios) are hypothetical calculations based on user-provided inputs. They do not account for taxes, business expenses, licensing fees, equipment costs, unsold inventory, or any other real-world variable.
• Free tier results are particularly approximate, as the Service applies default estimates that may differ significantly from your actual costs.
• Photo-based estimates (Pro feature) are automated guesses based on visual analysis and may be substantially different from a recipe's actual ingredients and quantities.

You should independently verify all cost and pricing information before making any business decisions. We recommend consulting with an accountant, business advisor, or financial professional for decisions that materially affect your income or business.

4. Not Business or Financial Advice

Nothing on Sweetlytics constitutes business advice, financial advice, legal advice, tax advice, or any other professional advice. The Service is intended solely to help bakers explore pricing as a starting point. Any action you take based on information from the Service is at your own risk.

Sweetlytics does not guarantee that using our suggested prices will result in profit, business success, or any particular financial outcome. Pricing a baked good involves many factors outside the scope of this tool, including local competition, customer perception, ingredient sourcing, regulatory requirements, and individual business costs.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Sweetlytics and its owner(s) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Service;
• Any business decision made in reliance on information provided by the Service;
• Inaccurate, incomplete, or outdated pricing estimates or market data;
• Loss of profits, revenue, customers, or business opportunities;
• Any errors or omissions in the generated output;
• Service interruptions, outages, or data loss;
• Unauthorized access to your account or data.

In no event shall our total liability to you exceed the amount you paid for one (1) month of your current subscription. If you are a free user, our total liability shall not exceed $10 USD.

6. Subscriptions, Billing, and Refund Policy

6.1 Free Tier

The free tier provides limited access to the Service at no charge. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

6.2 Pro Subscription

The Sweetlytics Pro plan is a paid monthly subscription. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

6.3 Cancellation

You may cancel your Pro subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. We do not prorate partial months.

6.4 No Refunds

If you believe you were charged in error, please contact us at the email address at the bottom of this page and we will review your case on a discretionary basis.

6.5 Price Changes

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice of any price increase, which will take effect at your next renewal date.

7. Generated Content and Usage Limits

Sweetlytics uses third-party automated models to parse recipes, estimate ingredients, and generate market data. Output is inherently probabilistic and non-deterministic. The same recipe submitted twice may produce different results.

Pro subscribers are subject to a monthly calculation limit as described in the Service. This limit exists to manage infrastructure costs and ensure fair access. Recalculations using cached data do not count against this limit.

We reserve the right to adjust usage limits at any time with reasonable notice.

8. Acceptable Use

You agree not to:

• Attempt to circumvent usage limits or access controls;
• Submit malicious, deceptive, or harmful content to the Service;
• Use the Service to reverse-engineer our models or pricing database;
• Share your account credentials with others;
• Resell or redistribute access to the Service;
• Use automated scripts or bots to access the Service;
• Use the Service in any way that violates applicable law.

We reserve the right to suspend or terminate your account without notice or refund if we determine you have violated these terms.

9. Data and Privacy

By using the Service, you agree that we may store your recipe inputs, calculation results, and usage data to provide and improve the Service. We do not sell your personal data to third parties.

Recipe text you submit may be processed by third-party providers subject to their own privacy policies. Do not submit confidential, proprietary, or legally protected recipes if you have concerns about this.

You are responsible for ensuring that any recipe you submit does not infringe on any third-party intellectual property rights.

10. Service Availability

We make no guarantee that the Service will be available at all times. The Service may be interrupted for maintenance, updates, or circumstances beyond our control (including third-party service outages). We are not liable for any losses resulting from Service unavailability.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will meet your requirements or produce any particular result.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sweetlytics and its owner(s) from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) any business decisions you make based on Service output; or (d) any third-party claims related to content you submit to the Service.

13. Modifications to Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on the Service. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Sweetlytics.
